These terms will in all respects be governed and construed in accordance with the laws of South Africa. The user submits to the non-exclusive jurisdiction of the Courts of South Africa.

Failure or neglect by us to enforce at any time these terms, will not be construed as a waiver of its rights, nor will such failure or neglect in anyway effect the validity or the whole or any part of these terms, nor prejudice our rights to take subsequent action.

Entire agreement

These terms constitute the entire agreement between the parties in respect of this subject matter.

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS, AND INDEMNITY AGREEMENT

Flying Fury Axes (Pty) Ltd includes all its owners, employees, agents, and representatives and is hereby further referred to as Flying Fury. 

In consideration of the opportunity to participate in “Flying Fury Axe Throwing” (the Event), I, the undersigned, confirm that I am of sound mind and that I am at least 18 years old. (For participants under 18 years of age, I, the legal guardian of the participant, give consent to participate in the Event and sign this document on his/her behalf.)

In addition, I acknowledge and agree as follows:

Acknowledgment of Risk: I understand that participating in the Event involves certain inherent risks, including but not limited to the risk of personal injury, property damage, or death. These risks include but are not limited to the risk of slipping, falling or being struck by axes or other equipment. I acknowledge that I have been informed of these risks and have had the opportunity to ask question about them. 

Participant Requirement: I acknowledge that it is my responsibility to follow all safety instructions and to wear appropriate clothing and footwear for the Event. I confirm that I am physically able to participate in the Event and that I have not been advised against participating by a medical professional.

Alcohol Consumption: I acknowledge that alcohol may be consumed at the Event venue and that Flying Fury will not be responsible for any actions or behaviors resulting from my, or any other participant's, consumption of alcohol. Should I choose to consume alcohol, it will be done responsibly and that I will not take part in the Event should it in any way influence my ability to participate safely. 

Waiver of Claims: I hereby waive and release any and all claims, actions, or causes of action that I may have against Flying Fury arising out of or related to my participation in the Event. This includes but is not limited to claims for personal injury, property damage, or wrongful death, whether caused by the negligence of Flying Fury or any other participant in the Event. 

Assumption of Risk: I assume all risks, known and unknown, associated with participating in the Event. I acknowledge that I am participating voluntarily and that I have had the opportunity to inspect the facilities and equipment used in the Event. 

Indemnification: I agree to indemnify and hold harmless Flying Fury from and against any and all claims, actions, or causes of action brought against them by any third party arising out of or related to my participation in the Event. This includes but is not limited to claims by family members, friends, or other third parties who may be affected by any injuries or damages resulting from my participation in the Event.

Medical Treatment: In the event of an injury or medical emergency during the Event, I authorize Flying Fury to seek and obtain any necessary medical treatment on my behalf. I agree to be responsible for any medical expenses that may be incurred as a result of such treatment.

Communication & Media: I consent to receive occasional communications from Flying Fury regarding future events, promotions, and updates. I also grant Flying Fury the right to use my name, photographs, and videos, taken during the Event, on their website or social media platforms for the purpose of sharing event highlights, scoreboard, showcasing participants and/or winners, and general event promotion. I understand that my personal information and media content will be handled responsibly and used solely for this purpose and in accordance with applicable privacy laws. I have the right to unsubscribe or opt-out from these communications at any time by contacting Flying Fury. I have the right to request the removal of my name or media content by contacting Flying Fury.

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa.
